Waiver of offshore family visa requirements

The Department of Home Affairs has recently announced there will be a waiver on the requirement for certain family visas (including the Prospective Marriage and Offshore Partner visa applicants) to be outside Australia for the grant of their visa from early 2021.

The regulations for some visas require applicants to be outside of Australia at the time the visa is granted. The Department has acknowledged travel restrictions are affecting visa applicants, particularly those who are in Australia and unable to exit the country to have their offshore visa application granted.

It is anticipated the changes will come into effect in early 2021.
The concession will apply to certain applicants for the following Family visa subclasses:

• Child (subclass 101)
• Adoption (subclass 102)
• Dependent Child (subclass 445)
• Prospective Marriage (subclass 300)
• Partner (subclass 309)
