Key information regarding Temporary visas and the Genuine Temporary Entrant (GTE) requirements.

For anyone considering temporary visas for study, work, or training in Australia, understanding the Genuine Temporary Entrant (GTE) requirement is essential. Established by the Department of Home Affairs, the GTE criterion is intended to ensure that applicants genuinely plan to stay in Australia temporarily.

The GTE is an assessment process where the Department of Home Affairs evaluates whether the applicant genuinely intends to stay in Australia temporarily, as specified by the visa conditions. It is an assessment based on the applicant’s individual circumstances. Usually you would use the GTE when applying for a Student visa (subclass 500).

As of the 2nd of August 2024, the policy regarding the GTE requirements for the Short-Term Stream (subclass 482) visa was updated. The new policy is much simpler and generally assumes that the GTE requirement is met unless there are specific concerns against it.

How can I demonstrate I meet the GTE requirement?

Here are some tips for providing a compelling GTE statement as part of your application:

  1. Clearly outline your reasons for choosing Australia as your destination and explain why you intend to return to your home country.
  2. Highlight personal, financial, and professional ties, such as family, employment, or property ownership, to demonstrate strong reasons to return.
  3. If you’re a student, explain how the course aligns with your career plans. For workers, detail how the training or job experience will enhance your future employment prospects back home.

What if my GTE application is refused?

If your application is refused due to GTE criteria, you can:

  • Request a review: applicants can seek a review of the decision through the Administrative Appeals Tribunal (AAT).
  • Submit additional documentation: it may be possible to reapply with additional evidence or clarification, you will have to confirm this with your migration agent.
  • Seek professional advice: consulting with migration experts, like us at Regional Migration Australia, can help you strengthen your application and avoid common pitfalls or refusals.
