Industry Labour Agreements are for a specific industry with fixed terms and conditions. Your industry must show ongoing labour shortages and extensive consultation within the industry.
There are currently 10 Industry Labour Agreements that are all listed below.
Advertising Industry
The Advertising Industry Labour Agreement lets you sponsor skilled overseas workers in the following five occupations:
- Advertising Specialist
- Graphic Designer
- Copywriter
- Multimedia Designer
- Web Developer
You can sponsor skilled overseas workers for these visas:
- Temporary Skill Shortage visa (subclass 482)
- Employer Nomination Scheme visa (subclass 186) after a three year transitional period
Before being able to lodge an application for a Labour Agreement, you must be endorsed by the Media Federation of Australia (MFA) and The Communications Council (TCC). There are salary rates you must match which are set by the Department.
Aged Care Industry
The Aged Care Industry Labour Agreement lets you sponsor skilled overseas workers in the following three occupations:
- Nursing Support Worker
- Personal Care Assistant
- Aged or Disabled Carer
You can sponsor skilled overseas workers for these visas:
- Temporary Skill Shortage (subclass 482) visa
- Employer Nomination Scheme (subclass 186) visa
Streamlined access to the Aged Care Industry Labour Agreement is provided to employers that enter into and maintain a Memorandum of Understanding (MoU) with relevant industry union(s).
You must employ the overseas workers on a full time basis, there are salary rates you must match which are set by the Department and you must meet the National Employment Standards.
Dairy Industry
The Dairy Industry Labour Agreement lets you sponsor skilled overseas workers in two occupations for a temporary stay of up to 4 years and/or for permanent residence. These are:
- Senior Dairy Cattle Farm Worker
- Dairy Cattle Farm Operator
You can sponsor skilled overseas workers for these visas:
- Temporary Skill Shortage visa (subclass 482)
- Employer Nomination Scheme visa (subclass 186) after a three year transition period
- Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)
You must employ the overseas workers on a full time basis, there are salary rates you must match which are set by the Department and you must meet the National Employment Standards.
Fishing Industry
The Fishing Industry Labour Agreement lets you sponsor skilled overseas workers in six occupations for a temporary period of up to 4 years and/or for permanent residence. These are:
- Deck Hand
- Fishing Hand
- Master Fisher
- Ship’s Engineer
- Ship’s Master
- Ship’s Officer
- Seafood Process Worker (available in Category 2 and 3 regional locations only)
You can sponsor skilled overseas workers on these visas:
- Temporary Skill Shortage visa (subclass 482)
- Employer Nomination Scheme visa (subclass 186) after a three year transition period
- Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)
You must employ the overseas workers on a full time basis and there are salary rates you must match which are set by the Department.
Horticulture Industry
The Horticulture Industry Labour Agreement lets you sponsor skilled overseas workers in 31 identified occupations for a temporary period of up to 4 years and/or for permanent residence. These are:
- Irrigation Designer/ Manager
- Agronomist
- Entomologist
- Horticulture Grower
- Protected Cropping Grower
- Horticulture Research & Development Officer
- Mechanical Engineer
- Horticulture Farm Manager
- Quality Assurance Manager
- Biosecurity Officer
- Facility Plant Manager
- Facility Supervisor
- Maintenance Electrician
- Fitter and Welder
- Agriculture Technician
- Mechanic
- Senior Nurseryperson
- Nurseryperson
- Nursery Supervisor
- Truck Driver
- Mobile Plant Operator
- Fork Lift Driver
- Irrigationist
- Irrigationist Assistant
- Horticulture Section Manager
- Section Supervisor
- Production Horticulture Supervisor
- Production Horticulturist
- Machinery Manager
- Machinery Supervisor
- Cold Storage Manager
You can sponsor skilled overseas workers for these visas:
- Temporary Skill Shortage visa (subclass 482)
- Skilled Employer Sponsored Regional visa (subclass 494)
- Employer Nomination Scheme visa (subclass 186).
You must meet the salary requirements in place for the above visas. You must also employ skilled overseas workers on a full-time basis.
Meat Industry
The Meat Industry Labour Agreement lets you sponsor skilled overseas workers in one occupation of for a temporary period up to 4 years and/or for permanent residence. This is:
- Skilled Meat Worker
You can sponsor a skilled overseas person on these visas:
- Temporary Skill Shortage visa (subclass 482)
- Employer Nomination Scheme visa (subclass 186) only after a three year transition period
- Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)
As the sponsor you must also:
- employ skilled overseas workers on a full-time basis
- ensure that if the skilled overseas worker is paid an annualised salary that they receive a top-up, if over an annual period, an Australian worker receives a higher amount for performing equivalent work
Minister of Religion
The Minister of Religion Industry Labour Agreement lets you sponsor skilled overseas workers in two occupations for temporary stay periods of up to 4 years and/or for permanent residency. These are:
- skill level 1 occupation of Minister of Religion. This person must have a senior leadership role in your organisation
- skill level 4 occupation of Religious Assistant
You can sponsor skilled overseas workers for these visas:
- Temporary Skill Shortage visa (subclass 482)
- Employer Nomination Scheme visa (subclass 186)
On-Hire
The On-hire Industry Labour Agreement lets you sponsor skilled overseas workers on a temporary basis for certain occupations. You can assign them to work for a third party but you must remain the direct employer.
You can sponsor skilled overseas workers on the Temporary Skill Shortage visa (subclass 482).
You can sponsor skilled overseas workers for an occupation on the list of eligible skilled occupations for the Temporary Skill Shortage visa (subclass 482) program. You may be able to sponsor them for periods up to 4 years.
You must employ the skilled overseas worker on a full-time basis. You must also pay them directly, not the third party.
The annual earnings for the skilled overseas worker for a standard 38-hour week must not be less than 20% above the rate of Temporary Skilled Migration Income Threshold (TSMIT). It must also not be less than what an Australian doing the same work in your approved workplace would be paid.
Pork Industry
The Pork Industry Labour Agreement lets you sponsor skilled overseas workers one occupation for temporary periods of up to 4 years and/or for permanent residence. This is:
- Senior Stockperson (piggery)
You can sponsor workers from overseas on these visas:
- Temporary Skill Shortage visa (subclass 482)
- Employer Nomination Scheme visa (subclass 186) after a three year transition period
- Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)
Restaurant (premium dining) Industry
The Restaurant (premium dining) Industry Labour Agreement lets you sponsor skilled overseas workers in four occupations for periods of up to 4 years and/or for permanent residence. These include:
- Chef
- Cook
- Café or Restaurant Manager
- Trade Waiter
You can sponsor skilled overseas workers for these visas:
- Temporary Skill Shortage visa (subclass 482)
- Skilled Employer Sponsored Regional visa (subclass 494)
- Employer Nomination Scheme visa (subclass 186) after a two year (Chefs and Cooks) or three year (Trade Waiters and Café or Restaurant Managers) transition period
As the employer, you must be a premium dining restaurant. This is a restaurant that offers a premium quality dining experience, and has the following attributes:
- employs highly experienced staff
- offers a wine list
- has revenue of at least $2 million per annum
- is non-franchised
- requires specialised front-of-house staff (including but not limited to Trade Waiters, Sommeliers, Maître D’s)
- requires specialised back-of-house staff (including but not limited to Wok Chefs, Sushi Chefs, specialized cuisine Chefs)
